1. Subject
These general terms of sale govern the relations between a company registered in The Netherlands (Zazou.eu) and any non-trading physical person purchasing products from the www.zazou.eu website. Consequently, all orders assume acceptance of these general terms of sale, which are applicable as a contract document, except if the parties do not make explicit alternative provisions to these conditions. By ordering products from Zazou.eu, the client accepts the general terms of sale.

2. Information
Care has been taken in compiling the information contained on this website. However, it is possible that some of the information is inaccurate, incomplete and/or outdated. Zazou.eu and its partners do not assume any responsibility for typing mistakes, omissions or programming errors as well as for the releases, information and prices mentioned, placed by third parties on the website. Consequently, Zazou.eu and its partners are not responsible for any transactions as a result of these errors.

3. Order
After having placed an order, the client shall receive a confirmation e-mail detailing their order and the total costs. Zazou.eu agrees to keep its website up to date. However, if an article ordered is no longer available, Zazou.eu shall contact the client as soon as possible.
Only the articles available and in stock can be ordered. The images illustrating the articles are not part of the contractual scope. If it contains errors, Zazou.eu can in no way be held responsible.

Before placing an order, you must provide the necessary information for the billing and delivery of the products. The information that you submit binds you. Zazou.eu cannot be held responsible for errors in the delivery details. Before settling the order, the client may modify it as well as their payment details.

4. Payment
Electronic payment can be done in several ways. The site lists the payment possibilities described in the FAQ. The order shall be shipped after reception of the payment.

After validation of the client’s details, the client can select their method of payment. The client’s order shall be automatically validated and constitute an irrevocable commitment on their part except within the limits of the cases stipulated in Article 9 of these conditions.

Payment is done exclusively on line, upon placing an order, by credit card or PayPal account. Only the credit cards Euro/MasterCard and VISA are accepted. In order to ensure payment security, the Zazou.eu site uses the PayPal secure payment service.

5. Prices
All prices, subject to change, on the Zazou.eu website are stated in euro, including VAT. The VAT corresponds to a value added tax of 19% in effect in The Netherlands. All our prices exclude shipping and customs clearance costs and can be modified at any time. Should the VAT rate change, the price of products may be modified.

If the client would like to know the price in another currency than the euro, they may use the converter. This converter is for information only and in no way can Zazou.eu be held responsible for the rate applied by the bank. The exchange rate on the day the payment is processed by the bank determines the amount due as compared to the amount indicated in euro.

6. Participation in the shipping and customs clearance costs
Shipping is at the expense of the client and can be modified at any given time. The shipping rates depend on the destination country and are charged over and above these rates.

For deliveries outside the European Union, the customs of the destination country shall calculate the customs clearance costs, which shall be at the expense of the client. Zazou.eu cannot give a definite answer as to the amount.

7. Shipping and delivery
Zazou.eu shall ship the order within 5 workdays after reception of the payment. In the event of technical problems considered as cases of force majeure, the order shall be shipped as soon as possible. Zazou.eu shall inform the client of this immediately.

TNT Post in The Netherlands handles the deliveries. Your package shall be delivered to you at the address you mentioned upon placing your order. In case of absence, the package shall be handled according to the standards and regulations in effect in the destination country.

Europe: The average delivery term given is 3 to 6 workdays, according to the delivery country. Outside Europe: The average delivery term given is 4 to 10 workdays, according to the delivery country. The delivery terms given by Zazou.eu are indicative and without guarantee. Zazou.eu cannot be held responsible for any delivery delays.

The maximum delivery term is 30 workdays as of the confirmation of the order by Zazou.eu. If the delivery does not take place within 30 days, the client may cancel the order.

Our goods always travel at the client’s own risk. The client is responsible for verifying the condition of the articles upon delivery of the package. The client has 48 hours to mention any complaints and claims to the carrier and must therefore immediately inform Zazou.eu by e-mail.

8. Retention of title
The transfer of ownership of the products at the time of delivery is suspended until the client has actually paid in full, which has no bearing on the transfer of risk.

9. Warranty and cancellation period
The client has the obligation to examine their order at delivery. If any deficiencies are found or the products do not correspond to the initial order the client must notice Zazou.eu within 7 working days after delivery, or as soon after the deficiency was discovered. In this case, only the claim of a valid credit on the Zazou.eu site, corresponding to the amount of the returned products, or the exchange for products of superior or equal value to those of the products returned, is possible, the difference remaining at the client’s expense.

If, for whatever reason, the client no longer wants their order, they have the right to return the product to Zazou.eu within 7 working days after reception. By returning the products according to the instructions for return, Zazou.eu shall reimburse the amount paid within 30 days. The costs of returning the products are at the expense of the client, except if these products do not correspond to the initial order.

Zazou.eu has no obligation whatsoever to reimburse shipping and packaging costs of the articles returned. If the client wants to return a product, he is asked to notify Zazou.eu beforehand and follow the instructions for return. If the products (including the packaging and labels) have been worn and/or washed, or damaged by the client, Zazou.eu reserves the right to withhold the purchase price in whole or in part as compensation.

It is not possible to return products that were made to measure and/or on the client’s request.

10. Zazou account
The Zazou account is a free service without obligation. By signing up, the client can benefit from several privileged services and special offers. The client is not obliged to open a Zazou account to place an order.

11. Queries/complaints
If the client has questions or complaints regarding the products purchased, they must contact Zazou.eu. The client shall receive an e-mail within 3 working days.

12. Personal information
To process an order, Zazou.eu needs a name, a billing address and a delivery address as well as payment details. The payment details are exclusively used to execute the payment of the articles purchased. The client’s personal information gathered by Zazou.eu is for their use and is treated as confidential. Zazou.eu shall use this information to execute the order and agrees to not divulge it to third parties. If the client signs up for a Zazou account and/or a newsletter, these data shall be used to inform the client of changes in the range, special offers, site improvements, services and any other relevant information about Zazou.eu.

When gathering these data, the client may decide if they want to be kept informed by e-mail of the activities of Zazou.eu. The client may give their permission or object to the use of the data gathered for the client database of Zazou.eu as well as their use by third parties. The client always has the right to access and modify their data. The client’s right to modify can be exercised by sending a request to info7@zazou.eu (please take out the number 7 in our email address before sending your email! It's there in order to limit spam). If the client no longer wishes to receive information about the offers and services of Zazou.eu, they may unsubscribe via the newsletter, via the website and/or via the Zazou account.

For statistical purposes, the count of visitors of the site Zazou.eu shall be saved. Information such as the number of visitors and visiting frequency shall be used for internal research and site improvement purposes. This information is in fact general in nature and does not target individual visitors. Visitor data remain unknown.

13. Liability
All products offered in the Zazou.eu range meet the usual, strict requirements and norms in effect. If the articles delivered by Zazou.eu do not meet the said guarantee, the liability towards the client shall be limited to what is stipulated in Article 9 of these conditions. The responsibility of the articles always lies with the manufacturer. Zazou.eu is not liable for any physical, material or immaterial damage, which may result from improper or injudicious use of the articles sold by Zazou.eu. When the manufacturer of a defective product is responsible for indirect damages, the responsibility of Zazou.eu shall be limited to the replacement of the article within the limit of available stocks, or a reimbursement of the purchase price.

Furthermore, Zazou.eu cannot be held liable if the client caused damages by ignoring the care instructions on the label of the products and/or gross negligence on their part.

In any case, Zazou.eu, its suppliers or any third parties who are mentioned on this site cannot be held liable for any damages whatsoever attributable to the use of this site.

14. Force majeure
Without prejudice to the other rights of Zazou.eu, Zazou.eu has the right, in the event of force majeure (i.e., problems concerning the order received or supply issues), to suspend the execution of the order or cancel the contract without legal intervention. Zazou.eu shall inform the client of its decision by e-mail within 3 working days. The client is not entitled to claim compensation from Zazou.eu, except if it would be unacceptable in accordance with the requirements of reasonableness and fairness.

15. Applicable law and competent court
The general terms of sales as well as every right, obligation, offer, order and contract applicable are governed exclusively by Dutch law. Any dispute shall be submitted to the competent court of Amsterdam in The Netherlands.
